End User License Agreement (EULA) - myion

Effective Date: January 1, 2025

This End User License Agreement ("Agreement") is a legally binding agreement between you ("User," "you," or "your") and Maclawran LLC ("Maclawran," "Company," "we," "us," or "our"), concerning your use of the myion mobile application ("App") and any related services provided by Maclawran LLC.

By downloading, installing, or using myion, you agree to be bound by this Agreement. If you do not agree to the terms, do not access or use myion.

Maclawran LLC grants you a revocable, non-exclusive, non-transferable, limited right to access and use myion solely to request and receive livestream video services for your personal use, strictly in accordance with the terms of this Agreement.

All rights, title, and interest in the app, its technology, and content remain the sole property of Maclawran LLC and its licensors. You are granted only a limited license to use myion; no ownership rights are transferred.

4. Payment and Fees

Use of livestream services through myion may require payment. You agree to pay all applicable fees and taxes as described at the time of purchase within the app.

5. Term & Termination

This license will remain in effect until terminated by you or Maclawran LLC. Maclawran LLC reserves the right to suspend or terminate your access to myion, without notice, for any violation of this Agreement. Upon termination, you must immediately cease all use and delete the app from your devices.

6. Warranty Disclaimer

myion and any related services are provided "AS IS" and "AS AVAILABLE," without any warranties, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Maclawran LLC will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of profits, data, or goodwill resulting from your use or inability to use myion. Our aggregate liability shall not exceed the total fees paid by you over the last twelve months.

Your use of myion is also governed by our Privacy Policy, incorporated by reference. Please review it for details on how we collect, process, and secure personal data.

9. Modifications & Updates

Maclawran LLC reserves the right to amend or update this Agreement at any time. Continued use of myion after changes are posted constitutes acceptance. Material changes will be communicated via the app or email.

12. Governing Law and Venue

This Agreement shall be governed by the laws of the State of Florida, without regard to conflict of laws principles. The parties agree that the exclusive venue for all actions and disputes arising from or related to this Agreement is in Monroe County, Florida.

13. Regulatory Compliance

You agree to abide by all applicable statutes, rules, and regulations of Florida and Monroe County when using myion, including consumer protection, privacy, and commercial laws.

14. Public Records Notice

If myion interacts with public entities or records, you acknowledge certain submitted information may be deemed public record under Chapter 119, Florida Statutes, and subject to disclosure.

15. Dispute Resolution

Any disputes not resolved informally shall be brought exclusively in courts located in Monroe County, Florida.

16. Entire Agreement

This EULA constitutes the entire agreement between you and Maclawran LLC regarding your use of myion and supersedes all prior understandings.

By clicking "I Accept," downloading, or using myion, you acknowledge that you have read, understood, and agree to be bound by this EULA.

This EULA can be referenced on the myion website and must be accepted by users during registration or before accessing livestreams for enforceability.
